Alternative dispute resolution for consumers (referred to as ADR) is the option available to all consumers to turn to official entities that help them resolve or provide guidance on a conflict, before resorting to litigation in the Courts.
Several independent entities are available, with specialized staff, who impartially help the consumer and the company/professional reach an amicable solution through mediation or conciliation.
If this agreement is not reached, recourse may still be made to arbitration, through a simple and fast process that is, in most cases, free of charge. The arbitration award has executive force (binding nature), being equivalent to a decision of a court of first instance.
Law no. 144/2015, of September 8, determines that suppliers of goods or providers of services established in national territory must inform consumers about the available ADR entities, or those to which they are bound by membership or by legal requirement arising from mandatory arbitration, and must also inform the entities' website address.
HALIOTIS has not joined any alternative dispute resolution mechanism.
